Terms of Service
Effective Date: January 9, 2026
These Terms of Service ("Terms") govern your use of Elevated Fitness & Mobility gym facilities and services. By purchasing a membership or using our facilities, you agree to these Terms.
Membership Terms
Membership Types
We offer the following membership options:
- Monthly memberships (Basic, Couples, Seniors, Veterans, Students)
- Day passes and week passes
- Personal training packages
- Group fitness classes
Payment and Billing
Monthly Memberships:
- Billed automatically on the same date each month
- Payment processed via Stripe
- You are responsible for keeping payment information current
- Failed payments may result in access suspension until payment is received
Passes and Packages:
- Day passes valid for single-day access
- Week passes valid for 7 consecutive days
- Personal training packages valid for specified timeframe (4-6 months depending on package)
Cancellation Policy
No Contracts - Cancel Anytime
- Monthly memberships may be canceled at any time through your Member Portal
- Cancellations take effect at the end of your current billing cycle
- No refunds for partial months
- Personal training packages are non-refundable after first session
Membership Freeze
Monthly memberships may be frozen for up to 60 days per calendar year:
- Contact us at gym@elevatedfitnessandmobility.com to request a freeze
- Minimum freeze period: 14 days
- No billing during freeze period
- Facility access suspended during freeze
Facility Use and Safety
Assumption of Risk and Release of Liability
IMPORTANT - READ CAREFULLY:
By using Elevated Fitness & Mobility facilities, you acknowledge and agree that:
- Physical exercise involves inherent risks including injury, illness, or death
- You are voluntarily participating in gym activities at your own risk
- You assume full responsibility for any injuries or damages that may occur
- You release Elevated Fitness & Mobility, its owners (Johnna Sutton and Clint Duchow), employees, and representatives from any liability for injuries, accidents, or health issues
Health Screening
Before using our facilities, you represent that:
- You are physically capable of participating in exercise activities
- You have no medical conditions that would make exercise dangerous
- You have consulted with a healthcare provider if you have health concerns
- You will inform trainers of any injuries, limitations, or health conditions
If you experience chest pain, dizziness, shortness of breath, or unusual symptoms, stop exercising immediately and seek medical attention.
Facility Rules
All members must:
- Use equipment safely and as intended
- Re-rack weights and clean equipment after use
- Wear appropriate athletic attire and closed-toe shoes
- Respect other members and maintain a supportive environment
- Report damaged equipment or safety hazards to staff
- Follow trainer instructions during classes and personal training sessions
Members must NOT:
- Use equipment while under the influence of drugs or alcohol
- Engage in disruptive, aggressive, or inappropriate behavior
- Use gym facilities for non-fitness purposes
- Film or photograph other members without consent
Guest Policy
- Guests must purchase a day pass to use facilities
- Members are responsible for guest behavior
- All guests must follow facility rules
Access and Security
24/7 Access:
- Monthly members receive 24/7 facility access via key code or access card
- Access codes/cards are non-transferable
- Do not share your access credentials with non-members
- Lost or stolen access credentials must be reported immediately
Personal Training and Classes
Personal Training Sessions
- Sessions must be scheduled in advance
- Cancel or reschedule at least 24 hours in advance or session may be forfeited
- Unused sessions expire per package terms (4-6 months)
- Sessions are non-transferable
Group Fitness Classes
- Pre-registration required
- Space subject to availability
- Arrive on time; late arrivals may be denied entry for safety
- No refunds for missed classes
Termination and Suspension
We reserve the right to terminate or suspend membership immediately for:
- Violation of these Terms or facility rules
- Threatening, harassing, or unsafe behavior
- Non-payment or fraudulent payment activity
- Damage to property or equipment
Terminated memberships are not eligible for refunds.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Elevated Fitness & Mobility shall not be liable for any injuries, losses, or damages arising from facility use
- We are not responsible for lost, stolen, or damaged personal property
- Our total liability shall not exceed the amount you paid for your membership
Indemnification
You agree to indemnify and hold harmless Elevated Fitness & Mobility, its owners, employees, and representatives from any claims, damages, or expenses arising from:
- Your use of the facility
- Your violation of these Terms
- Your violation of any law or rights of others
Changes to Terms
We may modify these Terms at any time. Changes will be effective upon posting with an updated "Effective Date." Continued use of our facilities constitutes acceptance of modified Terms.
Governing Law
These Terms are governed by the laws of the State of Washington. Any disputes shall be resolved in the courts of Okanogan County, Washington.

BY PURCHASING A MEMBERSHIP OR USING OUR FACILITIES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE, INCLUDING THE ASSUMPTION OF RISK AND RELEASE OF LIABILITY.
